PERSONAL DATA PROTECTION AND DISCLOSURE NOTICE UNDER PERSONAL DATA PROTECTION LEGISLATION

As the Practice of Prof. Dr. İsmail Mete İtil, we attach the utmost care and sensitivity to the processing of your personal data. In providing you with our services, we hereby inform you, within the scope of this Disclosure Notice, of certain matters regarding the collection and processing of all your personal data — including any special category personal data you provide to us — in accordance with Law No. 6698 on the Protection of Personal Data ("KVKK"), Law No. 3359 on Basic Health Services, Decree Law No. 663 on the Organization and Duties of the Ministry of Health and Its Affiliated Institutions, the Regulation on the Processing of Personal Health Data and Ensuring Data Privacy (the "Regulation"), the Regulation on Private Hospitals, Ministry of Health arrangements, and other applicable legislation.

Through this document, we wish to inform you which personal data we collect, how and for what purposes we use it, with whom we share it, how we seek to protect it, your rights concerning this data and how you may exercise them, and how you may contact us.

Explicit consent: Consent relating to a specific matter, given on the basis of being informed and expressed by free will.

Personal Data: Under the KVKK, personal data means any information relating to an identified or identifiable natural person.

Special Category Personal Data: Under the KVKK, special category personal data means data relating to race, ethnic origin, political opinion, philosophical belief, religion, sect or other beliefs, appearance and dress, membership of associations, foundations or trade unions, health, sexual life, criminal convictions and security measures, as well as your biometric and genetic data.

Data controller: The natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.

Pursuant to the KVKK, and in our capacity as Data Controller, we may record, store, update, and — where permitted and/or required by legislation or agreements — share and transfer your Personal Data to third parties (relatives of the person receiving services and/or public and/or private legal entities of which the service recipient is an employee/insured member, other public and/or private legal entities, and third parties from whom our Practice procures services or with whom it cooperates to carry out activities pertaining to the purposes specified in the legislation applicable to our Practice), classify it, anonymize it where necessary, destroy it, and process it in the manner set out in this Disclosure Notice and within the limits mandated by legislation, and as otherwise enumerated in the KVKK and related legislation.

Your health data, being special category personal data under the KVKK, may not be processed without your explicit consent. However, for the protection of public health, preventive medicine, medical diagnosis, treatment and care services, and the planning and management of health services and their financing, your health data may be processed without seeking your explicit consent by persons bound by an obligation of confidentiality or by competent institutions and organizations.

Your Personal Data is obtained by the Practice of Prof. Dr. İsmail Mete İtil for the purposes of protecting public health, preventive medicine, carrying out medical diagnosis, treatment and care services, and planning and managing health services and their financing, and similar purposes; it is obtained through our website, surveys, social media applications and all other channels, as well as in written form (patient identification forms, patient information and consent forms, etc.), verbally, visually, electronically, by e-mail, and through similar channels.

COLLECTION, PROCESSING AND PURPOSES OF PROCESSING PERSONAL DATA

Personal data collected by the Practice of Prof. Dr. İsmail Mete İtil may be processed, in accordance with the basic principles set out in the Law and the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law, for the purposes set out below:

  • Measuring and increasing patient satisfaction following the receipt of health services,

  • Analyzing your use of health services and retaining your health data in order to develop and improve the health services we provide to you, and responding to your questions or complaints regarding our services,

  • Sharing information requested by contracted institutions/organizations, in particular private insurance companies, within the scope of financing health services, and verifying identity,

  • Contacting you for informational and campaign purposes regarding the services provided by the Practice of Prof. Dr. İsmail Mete İtil, and, without limitation, carrying out and improving medical diagnosis, treatment and care services,

  • Providing information through marketing, media and communications, and helpline units; designing and delivering tangible and intangible benefits and special content through web and mobile channels; and carrying out activities to inform the public,

  • Carrying out our Practice's human resources policies, including processing our employees' data, in order to meet obligations mandated by the Labor Law, labor and social security legislation and other applicable legislation, as well as to increase performance levels and employee satisfaction and to ensure occupational safety and workplace harmony,

  • Planning and managing health services and their financing, and increasing and researching patient satisfaction and related matters,
  • \t
  • Other purposes, including: carrying out medical diagnosis, treatment and care services; carrying out emergency management processes; carrying out information security processes; carrying out candidate employee/intern/student selection and placement processes; carrying out application processes for candidate employees; fulfilling obligations arising from employment contracts and legislation for employees; carrying out fringe-benefits processes for employees; carrying out training activities; ensuring activities are carried out in compliance with legislation; carrying out finance and accounting operations; following up and carrying out legal affairs; carrying out communication activities; carrying out/auditing business activities; carrying out occupational health/safety activities; carrying out goods/service procurement processes; carrying out after-sales support services for goods/services; carrying out sales processes for goods/services; carrying out customer relationship management processes; carrying out storage and archiving activities; carrying out contract processes; following up requests/complaints; providing information to authorized persons, institutions and organizations; carrying out management activities; creating and following up visitor records; planning human resources processes; and other purposes relating to the provision of health services in the field of obstetrics and gynecology.

Your Personal Data obtained and processed pursuant to applicable legislation may be kept, in both digital and physical form, in the physical archives of the Practice of Prof. Dr. İsmail Mete İtil and/or transferred to computer environments.

CASES IN WHICH EXPLICIT CONSENT IS NOT REQUIRED FOR THE PROCESSING OF PERSONAL DATA

Personal data and Special Category Personal Data may not be processed without the explicit consent of the data subject. However, in the cases listed below (KVKK Art. 5, Art. 6, and Regulation Art. 7), your Personal Data may be processed without seeking explicit consent.

  3. Where processing of your Personal Data is mandatory for the protection of the life or physical integrity of yourself or of another person, in cases where you are unable to express consent due to actual impossibility or where your consent has no legal validity,

  5. Where processing of the Personal Data of the parties to a contract is necessary, provided it is directly related to the establishment or performance of that contract,

  7. Where processing is mandatory for us to fulfil a legal obligation,

  9. Where the Personal Data has been made public by you,

  11. Where processing is mandatory for the establishment, exercise or protection of a right,

  13. Where processing is mandatory for the legitimate interests of the Practice of Prof. Dr. İsmail Mete İtil, provided this does not harm your fundamental rights and freedoms,

  15. Where the data is necessary for the protection of health, medical diagnosis, treatment or management of health services, processing by persons under an obligation of confidentiality is not prohibited,

Personal data relating to health and sexual life may be processed without seeking the explicit consent of the data subject solely for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, and planning and management of health services and their financing, by persons under an obligation of confidentiality or by competent institutions and organizations,

  19. Special Category Personal Data of data subjects relating to race, ethnic origin, political opinions, religious or philosophical beliefs, sect or other beliefs, appearance and dress, or membership of associations, foundations or trade unions may be processed without seeking explicit consent in cases prescribed by law,

  21. Personal Data may be processed without seeking explicit consent where processed by foundations, associations and other non-profit organizations or formations established for political, philosophical, religious or trade-union purposes, provided that such processing complies with the legislation and purposes to which they are subject, is limited to their field of activity, is not disclosed to third parties, and concerns their current or former members and affiliates, or persons who are in regular contact with such organizations or formations.

PERIOD FOR WHICH PERSONAL DATA IS PROCESSED

Your Personal Data will be processed for as long as the purposes set out in this notice remain valid, in accordance with the KVKK and other legislation on the protection of personal data, and within the periods mandated by other legislation (including statutory periods such as limitation periods and periods relating to legitimate interests).

TRANSFER OF YOUR PERSONAL DATA

In line with the processing purposes set out above and based on legal grounds, your personal data may be transferred, within the framework of the personal data transfer conditions and purposes set out in Articles 8 and 9 of the KVKK, to persons/institutions and/or organizations permitted under Law No. 3359 on Basic Health Services, Decree Law No. 663 on the Organization and Duties of the Ministry of Health and Its Affiliated Institutions, Law No. 6698 on the Protection of Personal Data, the Regulation on the Processing of Personal Health Data and Ensuring Data Privacy and other related legislation — including private insurance companies, the Ministry of Health and its affiliated sub-units, healthcare institutions to which the patient is referred or which the patient applies to on their own, the Social Security Institution, the General Directorate of Security and other law-enforcement authorities, the General Directorate of Population, the Turkish Pharmacists' Association, courts and any judicial authority, central and other third parties, your authorized representatives, attorneys to whom you have granted a special power of attorney on the matter, your employer, tax and financial advisors and auditors and other third-party consultants from whom we receive advisory services, laboratories, medical centers, ambulance services, and medical device and health-service providers with whom we cooperate for medical diagnosis and treatment, regulatory and supervisory authorities, official authorities, and our business partners and other third parties (natural and/or legal) with whom we cooperate to develop or carry out health services for the purposes set out above — and may be transferred to third parties within Turkey and abroad. In this context, your shared personal data is shared by the Practice of Prof. Dr. İsmail Mete İtil only to the extent necessary and in a limited manner, in compliance with adequate protection and security measures for the protection of personal data. Your personal data may also be shared with competent public institutions and organizations where lawfully requested within the scope of their authority.

Subject to our legal obligations, your personal data will not be shared by the Practice of Prof. Dr. İsmail Mete İtil with third parties for any purpose unrelated to its products and services.

METHOD AND LEGAL BASIS OF COLLECTING PERSONAL DATA

Your personal data and special category personal data are collected for the purposes set out above, in accordance with the basic principles set out in the Law, on the legal grounds set out in Article 5(2) of the Law — namely being expressly provided for by law and being mandatory for the fulfilment of a legal obligation — provided your fundamental rights and freedoms are not harmed, through automatic or non-automatic methods listed below: directly, verbally, visually or in writing (patient identification forms, patient information and consent forms, patient history, etc.), by e-mail, through our call center, in physical form, over the internet, through our website and through social media, for the purposes set out in this disclosure notice, and are stored in physical or electronic form.

RIGHTS OF THE DATA SUBJECT

By applying to the Practice of Prof. Dr. İsmail Mete İtil, you have the right to:

  • Learn whether your personal data is being processed and, if so, request information relating to such processing,
  • \t
  • Learn the purpose of processing your personal data and whether it is used in accordance with that purpose,
  • \t
  • Learn the third parties/institutions and/or organizations, whether in Turkey or abroad, to which your Personal Data has been transferred,
  • \t
  • Request the correction or updating of your personal data if it has been processed incompletely or inaccurately,
  • \t
  • Request the deletion or destruction of your Personal Data if the grounds for processing no longer exist, or if the Practice of Prof. Dr. İsmail Mete İtil has no legal basis or legitimate interest for processing such data,
  • \t
  • Request that any actions taken pursuant to your request for correction, deletion or destruction of your personal data under the KVKK be notified to the third parties to whom your personal data has been transferred,
  • \t
  • Request compensation for any damage suffered as a result of the unlawful processing of your personal data,
  • \t
  • Withdraw the consent given under this Disclosure Notice.

Under the Law, you may submit your applications concerning your personal data, to the extent your Personal Data has been processed, in accordance with Article 11 of the KVKK, by delivering them in person to our Practice at Mimar Sinan Mahallesi, 1394 Sokak, No:14, Baysak 2 İş Merkezi, Kat:2, D:3, Alsancak, Konak/İZMİR; by sending them through a notary public; by e-mail bearing your secure electronic signature; or by sending a "Word or PDF" file bearing your secure electronic signature to meteitil@gmail.com. The Practice of Prof. Dr. İsmail Mete İtil will conclude your request free of charge, as promptly as possible and within no more than 30 (thirty) days, depending on its nature. Where fulfilling your requests entails a cost, the fee set out in the tariff determined by the Personal Data Protection Authority may be charged to you.

As a personal data subject, in order to exercise the rights set out above, your application must clearly and explicitly state the right you wish to exercise, and the matter requested must relate to you personally; if you are acting on behalf of another person, you must submit a notarized special power of attorney to that effect. Pursuant to the "Communiqué on the Procedures and Principles of Application to the Data Controller," your application must include your name and surname, signature, Turkish Republic ID number, residential or workplace address, e-mail address, telephone and fax number, and the subject of your request. Applications lacking these elements will be rejected. We are unable to evaluate applications that do not meet the requirements set out by the Personal Data Protection Authority under applicable legislation. If a request is rejected, the reason(s) for rejection will be stated in writing or electronically.

You may access the official website of the Personal Data Protection Authority, which contains the most up-to-date legislation and practices on the protection of personal data, at https://kvkk.gov.tr/. This Personal Data Protection and Disclosure Notice Under Personal Data Protection Legislation is governed by the laws of the Republic of Turkey. The courts and execution offices of İzmir shall have jurisdiction over any claim, matter or dispute that may arise. In the event of any discrepancy between the Turkish and English versions of this Personal Data Protection and Disclosure Notice Under Personal Data Protection Legislation, the Turkish version shall prevail.
